This Refund & Cancellation Policy explains how Choosy Dhanric (“Choosy Dhanric”, “Choosy”, “we”, “us”, or “our”) handles cancellations, refunds, credits and payment adjustments relating to our professional services.
Because Choosy Dhanric primarily provides customized professional services — including software development, AI systems, automation, digital products, design, engineering and consulting — work may involve reserved production capacity, planning, discovery, engineering time, third-party expenditure and other costs that begin before a final product is delivered. For that reason, refund eligibility depends on the circumstances of the engagement.
This Policy supplements the applicable proposal, statement of work, quotation, retainer agreement or other project-specific terms (“Engagement Terms”). Where expressly agreed Engagement Terms contain different refund or cancellation provisions, those Engagement Terms will govern the applicable project, subject to mandatory law.
Choosy Dhanric may require a deposit, advance payment, retainer or initial milestone before reserving production capacity or commencing work. A deposit may be used toward:
A deposit is not automatically refundable merely because the client later decides not to continue. Its treatment will depend on the Engagement Terms, the amount of work already performed, reserved capacity, third-party expenditure and applicable law.
If a client requests cancellation before substantive project work has started, Choosy Dhanric will review the circumstances. Where appropriate, amounts paid may be refundable after deducting any:
If a client cancels after work has begun, the client remains responsible for work completed up to the effective cancellation date. This can include research, planning, design, development, architecture, meetings, project management, technical configuration, testing, documentation, deployment preparation, integration work and other services already performed.
Where amounts paid exceed the amount properly due for completed work and committed costs, any refundable remainder will be assessed according to the applicable Engagement Terms. If work performed exceeds amounts already paid, Choosy Dhanric may invoice the remaining balance.
Projects may be divided into separate milestones. Once a milestone has been completed, delivered and accepted, fees attributable to that milestone are generally considered earned and are ordinarily not refundable solely because the client later decides to change direction or discontinue the project.
This does not prevent the client from reporting a genuine defect or failure to meet the agreed scope.
Deliverables that have been completed, delivered and accepted by the client are ordinarily treated as completed services. Acceptance may occur through express written approval or, where consistent with the project agreement, through deployment, commercial use, progression to a subsequent milestone or expiration of an agreed review period without a material scope-related objection.
A defect is different from a change request. Where a delivered item materially fails to conform to the agreed scope because of an implementation issue attributable to Choosy Dhanric, the client should notify us with reasonable detail. We should ordinarily be given a reasonable opportunity to investigate and correct the issue before a refund is considered.
A deliverable is not defective merely because the client later changes its preferred design, changes business direction, changes its technology preference, requests additional functionality or integrations, changes management, abandons the product, or develops new requirements. Such requests may be treated as additional scope.
Refunds will not ordinarily be provided merely because functionality not included in the agreed scope is absent from the delivered work. Project scope should be determined by the applicable Engagement Terms.
Some engagements require external purchases, including domains, hosting, cloud resources, software licences, premium plugins, APIs, AI usage, stock assets, fonts, datasets, application-store fees, payment-provider charges, external contractors or other third-party services. Where those charges cannot be recovered from the provider, they may not be refundable.
Cloud services, AI APIs, infrastructure, hosting and other usage-based services may generate charges based on consumption. Charges already incurred for actual usage are generally not refundable by Choosy Dhanric merely because the client later cancels the engagement.
Retainer arrangements are governed by their Engagement Terms. Unless expressly agreed otherwise, work already performed or capacity already consumed during a retainer period is not refundable. Termination notice requirements will be those specified in the applicable agreement.
Where Choosy Dhanric provides an ongoing subscription or recurring managed service, billing, renewal and cancellation provisions will be stated in the applicable Engagement Terms. Cancellation ordinarily prevents future renewals; it does not necessarily create entitlement to a refund for a billing period that has already begun.
A temporary pause does not necessarily constitute cancellation. If a project is paused because the client has not provided information, feedback, access, payment or approvals, Choosy Dhanric may reschedule remaining work based on future availability. Prolonged inactivity may result in project closure under the applicable Terms and Conditions.
If a client is charged twice for the same invoice because of a verified payment-processing error, the duplicate amount will be investigated and corrected.
If a client believes an incorrect amount was charged, the client should contact us promptly with the invoice reference, amount and relevant payment information.
A failed or declined payment authorization is not a completed payment and therefore does not constitute a refund. Temporary authorization holds may be controlled by the card issuer or financial institution rather than Choosy Dhanric.
Where payments are processed through an external payment provider, the refund may need to be issued through that provider. Processing time after initiation is controlled partly by the provider, bank, card network or financial institution. Choosy Dhanric cannot guarantee the exact date on which funds will appear in the client’s account after a refund is initiated.
International payments may involve foreign-exchange conversion, bank charges, correspondent-bank fees, card-network charges, processor fees or currency fluctuations. Where a refund is approved, the amount ultimately received in the client’s local currency may differ from the original converted amount because of factors outside Choosy Dhanric’s control.
Clients are encouraged to contact Choosy Dhanric before initiating a payment dispute or chargeback so that the matter can be investigated. A chargeback does not automatically extinguish a valid contractual payment obligation.
Where a chargeback is submitted, Choosy Dhanric may provide relevant project documents, invoices, delivery records and communications to the payment provider as reasonably necessary to respond to the dispute.
If Choosy Dhanric ends a project for reasons not caused by a client breach and is unable to deliver services for which payment has already been received, we will assess amounts attributable to undelivered work. Any amount determined to be refundable will be handled in accordance with the applicable Engagement Terms and law.
Where an engagement is terminated because of material non-payment, unlawful instructions, misuse, persistent non-cooperation or another material client breach, completed work and committed costs remain payable.
Approved refunds will ordinarily be made to an appropriate original or agreed payment method. Alternative payment arrangements may be used where required because the original payment method cannot receive the refund.
Choosy Dhanric will process approved refunds within a reasonable period. Actual settlement times after processing may vary according to the bank, card network, payment provider, currency and country involved.
Choosy Dhanric may request information reasonably necessary to verify a refund request and prevent payment fraud.
Nothing in this Policy removes any refund, cancellation or other right that cannot lawfully be excluded or restricted under applicable law.
